Broadband Deployment Board Update

On April 11 and 12, the Broadband Deployment Board (Board or BDB) began its review of the Minimum Requirement Decisions for all of the applications for the final 2024 Grant Cycle. Unfortunately, the Board was unable to complete its review, and therefore scheduled a final application review meeting for Wednesday, April 17 from 9:30 to 12:30 pm. Board staff will then post all final decisions on Thursday, April 18. Due to the additional meeting, the timeline has been updated (see below).

Appeals
According to Board policy, there are seven days to submit an appeal, and another seven days to submit a response to that appeal. Appellants must use the BDB Appeal Form and submit their appeal as an attachment to Board staff at oit_broadbanddeploymentboard@state.co.us by Thursday, April 25.


Responses to Appeals

The Board allows Interested Parties of a given appeal to file a response to that appeal. As the Board Appeal Policy states:

  • A response must take the form of a written letter. In the letter, the Board strongly encourages Interested Parties to address each basis of appeal contained in the Appeal Form submitted by the Appellant in short and plain statements.
  • Responses must be submitted no later than seven (7) days after the date of the Appeal Submission (for example: if an Appellant emails its Appeal Form in accordance with all submission requirements on January 1st, the Interested Party must submit its response via email on or by January 8th).
  • Submission Requirements: Responses must be emailed as attachments to Board staff at oit_broadbanddeploymentboard@state.co.us.

Any responses to an appeal must be submitted by Wednesday, May 1.


Appeals Timeline

  • The deadline to submit an appeal is Thursday, April 25.
  • Any responses to an appeal are due by Wednesday, May 1. All participants in the appeals process, including appellants and responders, must submit all presentation materials by this date as well.
  • The BDB will host an Appeals/Award Criteria Review Meeting Thursday, May 2.


Reminders

After the appeals process has concluded, the Board will operate under normal procedures, except for the following:

  • If there are funds remaining after the award of grant funds, applicants not funded under the first cohort review are invited to resubmit an updated application for a second cohort review in order for the Board to determine eligibility. New materials may be added. An appendix denoting the location of the new materials should be included in the submission.
  • Eligible submissions will be only for applicants who did not meet the minimum requirements as determined by the Board in the April 11, 12 and 17 board meetings.
  • Any applications that met the minimum requirements but were not funded are welcome to submit an updated application at the same time as the resubmission applicants.
  • The Board will work with staff and the GIS team to re-review coverage data to determine if an update needs to be made.
  • Staff are considering a request for Fabric ID locations in addition to the address list in order to better determine actual locations being submitted.
